The petitioner should download the necessary forms from the US Citizenship and Immigration Services (USCIS) website. You will need the I-129F Petition for Alien Fiance(e) and G-325A Biographic Information. You should always check that you are using the most recent version of the forms on the USCIS website.

The US petitioner should fill out the I-129F and a G-325A. Another G-325A should be filled out by the Alien fiance(e). It is recommended to fill out the forms on your computer, and then print. If you need to fill out the form by hand, in whole or in part, print very neatly in black ink.

The US petitioner should include documentation of citizenship. That can be either a copy of their Birth Certificate (front and back), a copy of naturalization certificate (front and back), or a copy of all pages of their US Passport (with a validity of at least 5 years). You only need to submit one of the above.

Write 2 letters declaring intent to marry. One for the petitioner to sign, and the other for the alien fiance(e) to sign. Both should specify that the marriage will occur within 90 days of the alien fiance(e) entering the US.

Include a 2"x2" passport style photo of both the petitioner and alien fiance(e). Each should have the name written on the back, be placed in a plastic bag with the name printed on it, and the plastic bag attached to a sheet of paper.

Gather evidence of having met within the previous 2 years. Primary evidence to include would be airplane boarding passes, passport stamps, hotel bills, or other documentation that you were in the same country. Secondary evidence, like photos of you together, should also be included. It is also advisable to include evidence of a continuing relationship, like copies of phone records, emails, text messages, and letters.

If the petitioner and/or alien fiance(e) have been married previously, include copies of the divorce decree(s) or certificate(s) if the marriage ended in divorce, or copies of death certificate(s) if the marriage ended in death.

If the petitioner and/or alien fiance(e) have previously had their name changed, provide copies of the marriage certificate, adoption decree, or court order that documented the name change.

The petitioner should create a cover letter noting what the application is for (K1 visa) and with a table of contents listing the materials are assembled in the package. Sign and date the cover letter.

Include the filing fee for the I-129F. Check or money order are accepted. Check the USCIS website for the current fee. ($455 as of May 09, 2009.)

Send copies of evidence of meeting and ongoing relationship. Keep the originals.
